By accessing or using the DRPHAUS website (drphaus.com) and purchasing our products, you agree to be bound by these Terms of Service. These terms are drafted in compliance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Legal Metrology Act, 2009, the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Please read them carefully before making a purchase.

1. General

DRPHAUS is operated by Badolla Enterprises, a proprietorship registered under Indian law. Throughout this site, the terms "we," "us," and "our" refer to DRPHAUS / Badolla Enterprises. We offer this website, including all information, tools, and services available to you, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

2. Products and Pricing

All products listed on DRPHAUS are subject to availability. We are an Indian brand selling products manufactured in India.

• Pricing (Transparency): All prices are listed in Indian Rupees (₹) and are inclusive of all applicable taxes. The Maximum Retail Price (MRP), selling price, and tax breakup are displayed on each product page as required under the Legal Metrology Act, 2009.
• GST: A 5% Goods and Services Tax (GST) under HSN Code 61091000 is included in the displayed price for all domestic orders. The applicable GST split (CGST 2.5% + SGST 2.5% for intra-state, or IGST 5% for inter-state) is shown on the invoice.
• Country of Origin: All products are Made in India. The country of origin is displayed on each product page.
• Sold by: All products are sold by DRPHAUS by Badolla Enterprises.
• MRP Display: The Maximum Retail Price (MRP), net quantity, date of manufacture/packaging, and manufacturer/importer details are displayed on each product page in compliance with the Legal Metrology (Packaged Commodities) Rules, 2011.
• We make every effort to display accurate product images and descriptions, but slight variations may occur due to screen calibration and manufacturing tolerances.
• Each collection is produced in limited batches (typically 200 pieces per design). We do not guarantee restocks.

3. Orders and Payment

When you place an order, you agree to provide accurate, current, and complete purchase information. In compliance with the Consumer Protection (E-Commerce) Rules, 2020:

• Payment is due at the time of purchase.
• We accept payments via credit/debit cards, UPI, net banking, Razorpay, and Cashfree as displayed at checkout.
• Orders are confirmed only after payment has been successfully processed.
• We provide a GST invoice for every order, which can be downloaded from the order confirmation page.
• We reserve the right to refuse or cancel any order for reasons including but not limited to: suspected fraud, incorrect pricing, or inventory unavailability.

4. Return, Refund, and Cancellation Policy (Consumer Protection Act, 2019)

In compliance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, our return, refund, and cancellation policy is as follows:

4.1 Returns

• Returns are accepted within 30 days of delivery for unworn, unwashed items with tags attached and in original condition.
• Items must be returned in original packaging.
• A prepaid return label is provided for eligible returns within India. The cost of the return label (₹49) will be deducted from your refund.
• Sale items and limited drops are final sale unless defective.

4.2 Refunds

• Refunds are processed within 5 business days of receiving and inspecting the returned item.
• Refunds are issued to the original payment method.
• Depending on your bank or card issuer, it may take an additional 3–5 business days for the refund to appear in your account.

4.3 Cancellations

• Orders can be cancelled within 24 hours of placement, provided they have not yet been processed for shipping.
• To cancel, please email hello@drphaus.com with your order number.
• Once an order has been shipped, it cannot be cancelled. Please initiate a return after delivery.

4.4 Warranty & Guarantee

• All DRPHAUS products are covered by a 30-day manufacturing defect warranty from the date of delivery.
• The warranty covers: print defects (cracking, peeling, misalignment within normal use), fabric defects (tears, holes, stitching errors present at delivery), and colour misprints.
• The warranty does NOT cover: damage from improper washing (use of bleach, hot water, machine drying), normal wear and tear, fading from sun exposure, or damage from alterations.
• For defective items, please email photos to hello@drphaus.com within 48 hours of delivery. We will issue a free replacement or full refund — no return needed for defects.

4.5 Size Exchanges

• Size exchanges are free within 30 days of delivery. We will ship the replacement size at no additional cost.
• To initiate a size exchange, email hello@drphaus.com with your order number and requested size.

5. Legal Metrology Act, 2009 Compliance

In compliance with the Legal Metrology Act, 2009 and the Legal Metrology (Packaged Commodities) Rules, 2011, the following information is displayed on each product page:

• MRP (Maximum Retail Price): ₹999 (inclusive of all taxes)
• Net Quantity: 1 unit (1 T-shirt)
• Date of Manufacture / Packing: As printed on the product packaging
• Manufactured By / Packed By / Imported By: Badolla Enterprises, A-1904, Brigade Panorama, Mysore Main Road, Bengaluru - 560074
• Country of Origin: India

The MRP includes all taxes. No additional charges beyond the MRP shall be applicable unless separately disclosed at the time of purchase (e.g., shipping charges, COD fee).

6. Shipping and Delivery

Shipping policies are detailed on our Shipping & Returns page. Key terms include:

• Domestic (India): 5–10 business days via India Post / Delhivery
• International: 10–20 business days via partner carriers
• Free shipping on orders over ₹999 within India
• We are not responsible for customs delays, duties, or import taxes for international orders
• Risk of loss passes to you upon delivery to the carrier

7. Intellectual Property & Copyright

All content on this website — including typographic designs, product images, text, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software — is the intellectual property of DRPHAUS / Badolla Enterprises and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and applicable international intellectual property laws.

• Design Copyright: Each typographic design featured on our products is an original artistic work and is protected under copyright law. Reproduction, distribution, or creation of derivative works on any medium (including other garments, merchandise, digital assets, or prints) without our express written permission is strictly prohibited.
• Trademark: DRPHAUS™, the DRPHAUS logo, and collection names are trademarks of Badolla Enterprises. Unauthorised use of these trademarks is prohibited.
• Limited License: You may view, download, and print pages from the website for your personal, non-commercial use only. Any other use requires our prior written consent.
• All rights reserved.

8. User Conduct & Intermediary Compliance (IT Act, 2000 & IT Rules, 2021)

As an intermediary under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, DRPHAUS provides a platform for the sale of products. When using our website, you agree not to:

• Use our site for any unlawful purpose or in violation of applicable Indian laws
• Attempt to gain unauthorized access to any part of our systems
• Interfere with the proper functioning of the website
• Use automated tools (scrapers, bots, crawlers) without our permission
• Submit false or misleading information
• Upload or transmit any content that is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, hateful, or racially/ethnically objectionable
• Infringe any patent, trademark, copyright, or other proprietary rights
• Violate any law for the time being in force

We reserve the right to remove any content that violates these rules and to report violations to law enforcement authorities. Our Grievance Officer (details in Section 14) handles complaints under the IT Rules, 2021.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, DRPHAUS and Badolla Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website. Our total liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim. Nothing in these terms shall limit our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Disclaimer of Warranties

Our products are provided "as is" and "as available." While we use 240GSM heavyweight cotton and DTF printing for durability, garment lifespan depends on care and usage. Our products are guaranteed to meet the description provided on the website. Any implied warranties are limited to the warranty period stated in Section 4.4.

11. Indemnification

You agree to indemnify, defend, and hold harmless DRPHAUS and Badolla Enterprises from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of our products or website, or your violation of any applicable Indian law.

12. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of our services shall be subject to the following dispute resolution process:

1. Informal Resolution: Contact us at hello@drphaus.com. We will attempt to resolve your concern within 30 days.
2. Consumer Forum: As a consumer, you may approach the National Consumer Disputes Redressal Commission (NCDRC) or the appropriate State/District Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.
3. Jurisdiction: Subject to the above, disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

13. Changes to Terms

We reserve the right to update, change, or replace any part of these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms. Material changes will be communicated via email to registered users.

14. Grievance Redressal & Contact

In compliance with the Consumer Protection (E-Commerce) Rules, 2020 (Rule 4), the IT (Intermediary Guidelines) Rules, 2021 (Rule 3), and the DPDP Act, 2023, the following Grievance Officer has been appointed:

Customers may also approach the appropriate consumer forum under the Consumer Protection Act, 2019 if their grievance is not resolved satisfactorily.
